FALSE FULTON COUNTY ESTATE DEED ALERT ON: 686 CEDAR AVENUE, ATLANTA, GEORGIA 30318


UPDATE TO THIS POST!  AS OF 6/21/19 AFFIANT AND BENEFICIARY MICHAEL BURKE.  HAS FILED A SECOND "SWORN AFFIDAVIT" UPON HIS LATE FATHER'S ESTATE PROPERTY.  AGAIN FORMALLY REPORTING FALSE DEED FILINGS, AND NOW MORTGAGE FRAUD UPON IT!




ATTENTION EVERYONE WHO IS A HOMEOWNER IN FULTON COUNTY, GEORGIA AND YOU HAVE A LAST WILL AND TESTAMENT. 

THE FULTON COUNTY PROBATE COURT, IS KNOWINGLY VIOLATING GEORGIA LAW, BY ALLOWING THE EXECUTOR, OR EXECUTRIX OF YOUR ESTATE TO CHANGE THE TERMS OF YOUR LAST WILL AND TESTAMENT, AFTER YOU'RE DECEASED!

How do I know this? It happened to my friend Michael Burke, and his brothers concerning their late father Johnny Burke Sr.

The late Johnny Burke Sr. left an October 25, 2011 Last Will And Testament. In it at ITEM II(a)(b) it provides the following below:


a.  I give, bequeath and devise to Birdine Harris my daughter, to equally divide all

of my real and personal property at 686 Cedar Avenue, Atlanta, Georgia 30318 to

Johnny Burke Jr., Robert Hughes, Michael Burke, Johnny Bernard Burke, Eloise

Gillon, Louise Johnson, Shirley Stovall, Jacqueline Jefferson, and Birdine Harris. I give,

bequeath and devise to Birdine Harris, my daughter to use the Life Insurance I have

with American General Life Insurance and Accident, and Liberty Bankers Life 

Insurance Company to be used for my funeral.

b.  I give, bequeath, devise and appoint all the rest, residue, and remainder of my

property, of whatever kind and description and wherever located, to Johnny Burke 

Jr., Robert Hughes, Michael Burke, Johnny Bernard Burke, Eloise Gillon, Louise 

Johnson, Shirley Stovall, Jacqueline Jefferson, and Birdine Harris.

The late Johnny Burke Sr. passed away on October 14, 2014 and Fulton County Probate Judge Pinkie T. Toomer, didn't care what the late Johnny Burke Sr.'s Will had to say! 

Birdine Harris, the appointed Executrix of the Estate didn't want any of the remaining Beneficiaries to LEGALLY INHERIT any of the late Johnny Burke Sr.'s REAL nor PERSONAL PROPERTY.

Fulton County Probate Judge Pinkie T. Toomer allowed Birdine Harris to UNLAWFULLY SALE the late Johnny Burke Sr.'s Estate real property on October 20, 2017. 

Birdine Harris DID NOT HAVE TO ABIDE BY THE TERMS OF THE LATE JOHNNY BURKE SR.'S WILL.

Birdine Harris also KNOWINGLY LIED about her sale price of this property as well. On October 20, 2017 this is what she told Fulton County Probate Judge Pinkie T. Toomer in open Court below. Taken from the Fulton County Probate Court's 10/20/17 ORDER:

At the hearing Petitioner stated that she anticipated that although there was a current contract for the sale of the Property, someone has offered to purchase it at a higher price.

As such on October 11, 2017, Petitioner filed an Amendment to the Petition with a contract to sell the Property for $60,000.00. The Ad Valorem tax value of the Property is $31,500.00.

Now I want EVERYONE to read what Birdine Harris told Fulton County Probate Judge Pinkie T. Toomer, outside of the purview of ANY OF THE BENEFICIARIES within the Fulton County Probate Court's 7/9/18 ORDER below:

The sale of the real property for $60,000.00 was authorized by Court Order on October 20, 2017. 

On November 7, 2017 the Executor filed a new contract for the property with a sales price of $40,000.00. 

On November 28, 2017, the Executor informed the Court that the contract for $60,000.00 had fallen through and that the property had in fact sold for $40,000.00.

Below I want EVERYONE to take a look at what Birdine Harris TRULY sold 686 Cedar Avenue, Atlanta, Georgia 30318 for on November 20, 2017 to BEST BUY HOMES, LLC. 

BIRDINE HARRIS, UNLAWFULLY SOLD THE LATE JOHNNY BURKE SR.'S ESTATE PROPERTY TO BEST, BUY HOMES, LLC FOR $46,269.97 WITH NO COURT OVERSIGHT!

Now look at what the purchaser, of this Estate property BEST BUY HOMES, LLC resold it for on December 1. 2017.

But yet on November 28, 2017 Birdine Harris told Fulton County Probate Judge Pinkie T. Toomer that her sale of $60,000.00 with BEST BUY HOMES, LLC FELL THROUGH! REALLY? 

WELL HOW IN HELL COULD BEST BUY HOMES, LLC. RESALE THE SAME PROPERTY FOR $61,500.00 AND $1,500.00 MORE THAN BIRDINE HARRIS TO PARADISE GOLD, LLC ON DECEMBER 1. 2017?

SO 686 CEDAR AVENUE, ATLANTA, GA 30318 WITH A FAIR MARKET VALUE OF $31,500.00 SOLD "TWICE" AND FOR $107,769.97 BETWEEN NOVEMBER 20, 2017 AND DECEMBER 1, 2017?

Well according to the Fulton County Tax Assessor's Office, this estate property is CURRENTLY FAIR MARKET VALUED at
$35,500.00 with an ASSESSED VALUE of $14,200.00 but yet the correct property taxes have not been paid on this estate property!

But yet this estate property was UNLAWFULLY SOLD TWICE, WITHIN 2 MONTHS, totalling $107,769.97 with NO CONTRACTS on file in the Fulton County Probate Court. Nor the Fulton County Superior Court! Showing either of these ILLEGAL real estate transactions, that any Presiding Judge has seen, APPROVED OF, and drafted a LEGAL ORDER upon!

Also EVERYONE I want you to know that Birdine Harris KNOWINGLY LIED upon the Last Will And Testament of the late Johnny Burke Sr.! 

Within Birdine Harris' 11/20/17 Executor Deed, she stated under WITNESSETH that she was acting upon the POWER AND AUTHORITY CONTAINED IN THE WILL. 

Birdine Harris was referring to "ITEM VII" of the late Johnny Burke Sr.'s Will.  Well "ITEM VII" of the late Johnny Burke Sr.'s Will provides the following below:

"Should the members of my immediate family, that is myself and my children A Johnny Burke Jr., Robert Hughes, Michael Burke, Johnny Bernard Burke, Eloise Gillon, Louise Johnson, Shirley Stovall, Jacqueline Jefferson and Birdine Harris, fail to survive the making of this Will or all of us shall perish as a result of a common disaster, I desire that the entire estate of which I am vested at the time of my death be divided among my grand-children."

Now where in "ITEM VII" of the late Johnny Burke Sr.'s Will did he grant any POWER or AUTHORITY to Birdine Harris. To sell his REAL or PERSONAL PROPERTY to BEST BUY HOMES, LLC ON NOVEMBER 20, 2017?

As EVERYONE CLEARLY SEES that Birdine Harris got her POWER and AUTHORITY from Fulton County Probate Judge Pinkie T. Toomer, on October 20, 2017. 

What Birdine Harris, along with BEST BUY HOMES, LLC and PARADISE GOLD, LLC has committed is a FELONY. Pursuant to O.C.G.A. 16-10-20.1 FALSE DOCUMENTS.

Birdine Harris has filed FALSE DEEDS in the Fulton County Deeds and Records Division on December 14, 2017. 

The late Johnny Burke Sr.'s property was supposed to go to 9 individuals he named in his Will. His property was NOT TO BE SOLD BY BIRDINE HARRIS, WITH THE UNLAWFUL PERMISSION OF CORRUPT FULTON COUNTY PROBATE JUDGE PINKIE T. TOOMER, ON OCTOBER 20, 2017.

To prove my "PRIMA FACIE CASE" even further, that neither Fulton County Probate Judge Pinkie T. Toomer, nor Birdine Harris. Has the "LEGAL AUTHORITY TO CHANGE THE TERMS OF THE LATE JOHNNY BURKE SR.'S ALREADY ESTABLISHED TERMS OF HIS WILL. 

Read a September 12, 2011 Supreme Court of Georgia Opinion, below where Fulton County Probate Judge Pinkie T. Toomer ABIDED BY THE LATE RAY SR.'S TERMS OF HIS WILL. AND "ONLY" BECAUSE SHE DID, THE SUPREME COURT OF GEORGIA "AFFIRMED" HER RULING!

BUT YET SHE DIDN'T DO THE SAME FOR THE LATE JOHNNY BURKE SR., WHEN SHE WAS "REQUIRED" TO DO SO! 

THE SUPREME COURT OF GEORGIA RULED, "THE TESTATOR'S INTENT MUST PREVAIL!"
